Please read these Terms of Use ("Terms of Use", "Terms", "Terms and Conditions") carefully before using the Application Services operated by Creatify ("us", "we", or "our"). The "Application Services" (the "Service") shall mean the app and programming interfaces under 'Creatify'. A "Subscription(s)" shall mean a specified pricing plan and term length with associated features, functionality and volume tiers for the Application Services purchased by Customer.
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.
You must be at least 13 years old to use Creatify. We do not knowingly collect personally identifiable information from children under 13. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.
Our Privacy Policy describes how we collect, use, share, or otherwise process information about you and your use of the Service.
You are responsible for all activity on your account. Don’t do anything illegal, abuse others, or misuse the Service. If you violate our policies we may suspend your access to certain features or terminate your account.
Creatify provides a portion of its Service at no cost, referred to as "Creatify Free." Additionally, we offer paid subscription plans which grant enhanced services and more Creatify Content ("Subscription"). Subscriptions can be acquired directly from us or via a third party, such as the iOS App Store or Google Play. Purchasing through a third party might also subject you to their own terms in conjunction with ours.
Your Subscription payment, whether made to us or a third party vendor, will renew automatically until it is cancelled. To avoid charges for the next billing cycle, you must cancel your Subscription before the renewal date (refer to "Cancellation and Refunds" for more details). We maintain the right to alter, discontinue, or update our subscription offerings periodically. For active Subscriptions, any substantial changes will be communicated to you in advance.
Subscriptions are intended for individual use unless otherwise stated to include multiple users. Subscription sharing is not permitted. Each Subscription may be used on up to ten devices, provided they all use the same operating system.
You must supply a valid payment method, such as a credit card, that is accepted by either us or the third party from whom you've bought the Subscription to settle the corresponding fee. The selected payment method will be billed for the subscription fee, along with any relevant taxes, regularly based on your Subscription's term. You are entirely accountable for all charges incurred on the payment method you provide. If we are unable to process a charge successfully on your payment method, we retain the authority to terminate your Subscription.
The Service may feature ads that could direct you to websites operated by third parties. We neither endorse nor assume responsibility for these third-party ads, websites, products, or services, as they are outside our jurisdiction. Your interactions with advertisers on the Service are strictly between you and those advertisers. You acknowledge that we are not responsible for any potential losses or claims you may have in connection with an advertiser. Furthermore, you understand that your use of the Service may contribute to our earnings, enhance our reputation, or boost our overall value through advertising sales, and you are not entitled to any portion of such income or increased value.
Creatify and its licensors hold exclusive rights to the Service's unique content, features, and capabilities. This Service is shielded by the copyright, trademark, and other legal protections of all nations. Usage of our trademarks and trade dress with any product or service is forbidden without Creatify's explicit written permission.
In no event shall Creatify nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Creatify, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
ThisPolicy may be subject to changes at our discretion from time to time. Whenever such changes are made, we will make sure to update the version available on this page, unless there's a requirement for a different form of notification under the applicable law.
